Mandatory arbitration is a despicable anathema to substantive and procedural Due Process. It is a direct violation of Due Process and Equal Protection Under Law, and repugnant to American traditions and the American Constitution. Dr. Nuzzo must demand that any mandatory arbitration finding be thrown out on the basis of due process and equal protection constitutional violations, conflict-of-interest and bias (especially political and gender bias).
Even still. If one is forced to sign a non-disparagement or non-disclosure agreement, they also need to include an addendum in the agreement to say that if unsatisfied with outcome of mandatory arbitration, one can still file suit in the courts and litigate it. From what I have heard, the fines apply to platforms (Facebook, Instagram, etc,) and not to individuals. I could be wrong.
Also, would connecting to a VPN server that is outside of California (or outside the USA) prevent this issue?
